Acceptance of Contract Terms

By accessing, browsing and/or using this site (“Site”), you acknowledge that you have read, understood and agree to be bound by these terms and to comply with all applicable laws and regulations. If you do not agree to these terms, do not use this Site. The material provided on this Site is protected by law, including, but not limited to, U.S. copyright law and international treaties. This Site is controlled and operated by the Agricultural Fertilizer Research and Education Council of Minnesota (AFREC) from its offices within the United States. AFREC makes no representation that materials in the Site are appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws. Any claim relating to, and the use of, this Site and materials contained herein is governed by the laws of the state of Minnesota.

Limitation of Liability

Under no circumstances, including, but not limited to, negligence, shall AFREC be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this Site, even if AFREC or an AFREC representative has been advised of the possibility of such damages.

Our Transmissions

All personal data provided to AFREC through its website will be handled in accordance with AFREC’s Online Privacy Practices. You are prohibited from posting or transmitting to or from this Site any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic or profane material, or any other material that could give rise to any civil or criminal liability under the law. Unauthorized attempts to upload or change information on this Site are strictly prohibited and may be punishable under applicable federal and/or state law.

Links to websites outside Minnesota state government or the use of trade, firm or corporation names within this Site are for the convenience of the user. Such links and use do not constitute an express or implied official endorsement or approval by the Agricultural Fertilizer Research and Education Council of any private-sector website, or of the products or services of specifically identified companies or private entities that may have contributed to this “Site.”

AFREC may at any time revise these Terms of Use by updating this posting. By using this Site, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current Terms of Use to which you are bound.

Privacy Policy

AFREC is responsible for the enforcement of and compliance to various state laws. This requires the collection of company data and, in some cases, personal information. AFREC will protect the collected information pursuant to the Minnesota Government Data Practices Act (MGDPA), Minnesota Statutes, Chapter 13.

We will collect and store nonpersonal information (i.e., the domain from which you access the Internet; the date and time you access our Site; the Internet address of the website from which you linked to our Site; and the information you view while visiting our website) for internal statistical purposes. We may also collect personal information such as a home address, home phone number or personal email address that you provide via email or in a request for information, registration, feedback or comment form. This information is necessary to respond to and provide the level of service you requested. We will not disclose, sell or transfer any personal information to any third party unless required by law or authorized by you to do so.

Under the MGDPA, you have a right to challenge the accuracy of any personal data made available for public viewing on any AFREC website.
